Crossley Smart Repairs

1.Estimates

Any estimate provided before an in-person inspection of the vehicle is for guidance only and may be revised following further assessment. A final quotation will be issued once the vehicle has been inspected and the full extent of the required repairs has been determined. 

If additional damage is discovered during a repair, this may result in a revised quotation. No additional chargeable work will commence on a vehicle without customer’s approval.

2.Bookings and appointments

Once a booking has been confirmed, we will make every effort to attend as scheduled. However, as our services are provided on a mobile basis, all appointments are subject to weather conditions. Should we be unable to attend as scheduled for any reason, we will contact you as soon as possible. We reserve the right to arrange an alternative appointment.

If for any reason, including but not limited to adverse weather conditions, ‘Crossley Smart Repairs’ is unable to carry out the repairs on the scheduled booking date, we shall not be liable for any costs, losses, damages or inconvenience incurred by the customer as a result of the postponement or cancellation of the appointment.

3. Location of the repair 

Repairs may be carried out at any location agreed upon with the customer, provided that the repairer considers the location to be safe and suitable for the work to be undertaken. Customers must provide access to the vehicle at the agreed time and location. Customers must also provide a power source where we can plug into a standard plug socket to carry out your repair. Wherever possible, repairs will be completed on a private driveway or in another safe off-road location. If this is not possible, ‘Crossley Smart Repairs’ reserves the right to propose an alternative location or arrange for the repair to be carried out at a different date and time.

If, for any reason, including but not limited to adverse weather conditions, ‘Crossley Smart Repairs’ is unable to carry out the repair on the scheduled booking date, we reserve the right to postpone the appointment. ‘Crossley Smart Repairs’ shall not be held liable for any costs, losses, expenses or inconvenience incurred by the customer as a result of such postponement or cancellation.

4. Vehicle condition

The customer confirms that the vehicle is safe to work on and that they have authority to authorise the repair. ‘Crossley Smart Repairs’ reserves the right to refuse work where the vehicle is considered unsafe or unsuitable for repair.

The customer confirms that all personal belongings and valuables have been removed from the vehicle prior to the repair. ‘Crossley Smart Repairs’ accepts no responsibility for loss or damage to personal property left within the vehicle.

5. Cancellation Policy

You may cancel your agreed booking by cancelling ‘Crossley Smart Repairs’ via telephone or email no later than 24 hours before the scheduled appointment date and time. 

6. Repair Standards

While every effort is made to achieve an excellent colour match and finish, repairs carried out by ‘Crossley Smart Repairs’ may not be identical to the original factory finish, which is applied using automated manufacturing processes to tolerances beyond those achievable by hand. However, we will provide a high-quality repair completed to a professional standard.

The customer acknowledges that end-of-lease inspectors, due to their training and expertise, may be able to identify repairs that have been carried out to the vehicle, notwithstanding the quality of the repair.

7. Cosmetic Improvement Work 

Work carried out to improve appearance of a vehicle, including but not limited to stone chip treatment, touch-in repairs and other cosmetic enhancement, shall not be regarded as a full repair. Such services are intended to improve the appearance of the affected area only, and no guarantee is given as to the extent of the improvement achieved or the final aesthetic outcome.

8. Existing damage

‘Crossley Smart Repairs’ shall not be responsible for pre-existing damage, defects, corrosion, previous repairs, paint deterioration or other underlying conditions which become apparent during or after the repair process.

9. Warranty

‘Crossley Smart Repairs’ offers a 12-month warranty on repairs carried out by us, subject to the exclusions set out below.

The warranty does not cover any damage, defect or deterioration arising from:

  • Corrosion, rust, or oxidation
  • Stone chips, scratches, or touch-in repairs
  • Any subsequent accident, collision, impact, or damage affecting the repaired area
  • Failure to follow the aftercare instructions provided upon completion of the repair.
  • Fair wear and tear, environmental factors, or circumstances beyond our control

In addition, no warranty can be provided where the area requiring repair has been previously repaired by another party, or where there is evidence of a prior repair to the affected area.

Any warranty claim must be reported within a reasonable time after the defect becomes apparent and, where reasonably possible, within 14 days of discovery. In the unlikely event of having to make a warranty claim please contact ‘Crossley Smart Repairs’ by telephone or email crossleysmartrepairs@gmail.com. The vehicle must be made available for inspection before any third-party repair work is undertaken.

10.Payment terms

Payment in full is due immediately upon completion of the repair. Payment may be made by cash, debit or credit card, or bank transfer, subject to the availability of the relevant payment method at the time of payment. 

Where payment is made by bank transfer, funds must be received and cleared in the ‘Crossley Smart Repairs’ bank account before payment will be deemed to have been made. 

Crossley Smart Repairs reserves the right to recover reasonable costs incurred in recovering overdue payments.

‘Crossley Smart Repairs’ reserves the right to withhold the release of a vehicle or any completed work until full payment has been received and cleared.

11.Liability 

Subject to applicable law, the total liability of ‘Crossley Smart Repairs’ arising from any repair shall not exceed the amount paid by the customer for that repair.

‘Crossley Smart Repairs’ does not accept any responsibility for indirect losses, loss of earnings, inconvenience, vehicle hire costs, or consequential losses, subject to applicable law.

‘Crossley Smart Repairs’ shall not be liable for delay or failure to perform its obligations due to events outside its reasonable control, including adverse weather, traffic incidents, equipment failure, illness, supply shortages or other unforeseen circumstances.

Nothing excludes liability where exclusion is prohibited by law. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot legally be excluded

12.Photographs 

Photographs may be taken for record-keeping and quality-control purposes. Photographs used for marketing purposes will only be used with the customer's prior consent.

13.Complaints Procedure

Any concerns regarding the quality of a repair should be reported to Crossley Smart Repairs within 7 days of completion where reasonably possible.  The customer must provide ‘Crossley Smart Repairs’ with a reasonable opportunity to inspect and where appropriate, rectify the issue before any third party undertakes remedial work. Failure to do so may invalidate any warranty or claim relating to the repair.

14.Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
